Private Sale:
This is a private negotiated sale and not an auction. Seller reserves the right to accept any offer at any time, reject any or all offers, or negotiate a sale with one or more buyers whichever may be most advantageous to the Seller.
Warranties:
All items are sold "as is, where is" without warranty, express or implied. This includes, but is not limited to, any warranties of merchantability or fitness for a particular purpose.
Information Provided & Advertising Materials:
The description and information provided by CapX1, LLC is for advertising purposes only. CapX1, LLC its officers, directors, employees and agents use their best efforts in obtaining and developing advertising information for listed items, but make no representation nor warranty as to the accuracy or completeness of such information. Buyer is responsible for inspecting the equipment and is solely responsible to determine the condition and suitability of any advertised item. Buyer relies on all advertising materials at its own risk.
Payment:
Payment in full required prior to removal of equipment. Payment shall be made to CapX1, LLC in a form acceptable to Seller within two business days of Invoice.
Sales & Refunds:
All sales are final. No refunds.
Rigging & Removal
Unless otherwise mutually agreed to in writing, Buyer is responsible for rigging & removal of all equipment. CapX1 has obtained rigging, removal & loading prices from local riggers and can coordinate removal activities for an additional fee at Buyer's request.
Loading:
Unless otherwise mutually agreed to in writing, Buyer is responsible for loading all equipment.
Schedule:
All equipment is immediately available. Buyer may initiate removal activities at its convenience once payment in full is received and applicable insurance requirements have been met.
Deadlines for Removal of Equipment
- On or Before July 1, 2022
- Tanks & Fermentation Equipment;
- Boiler;
- Bulk Material Storage Silos located on the West side of the plant; and
- All Other Equipment including Miscellaneous Equipment located inside the plant except Grain Milling Equipment.
- September 1, 2022
- Agrex Grain Milling Equipment located inside the plant; and
- Distiller's Grain Drying/Processing Equipment located immediately outside the Southwest corner of the plant.
- Negotiable
- Distillation Equipment located immediately North of the plant.
- Cooling Tower & Related Equipment located South of plant
Insurance:
Prior to initiation of removal activities, Buyer shall provide certificates of insurance as required by Seller. Certificates of insurance shall name Seller and CapX1, LLC as additional insureds.
Acceptance:
By making an offer,Buyer agrees that it has read, understands and agrees to the above schedule and conditions.
